Social Insurance for Chinese employees in China is a complex system.
It includes 5 types of insurances:
Both company and employee have to make payments for Social Insurance, plus a House Fund (excluding Maternity and Work- related Injuries – these types are paid only by company).
Employers have to pay attention and take care of Social Insurance, otherwise any violation of the Social Insurance Law will result in obligation to pay the whole amount of Social Insurance depending on the employee’s salary and working period. The violation of the law includes not only not paying the insurance at all, but also failing to pay all 5 types and Housing Fund. Moreover, employer cannot claim lower salary than an employee actually has.
Employees in China are protected by Law and they can go to the Labor Department claiming that company violated the law.
